Jackson Walker Wins Appellate Victory for Bankcard Processing International

 

On Aug. 30, 2012, Jackson Walker obtained a key victory for its client, Bankcard Processing International L.L.C., when the Court of Appeals for the First District of Texas overturned a $1.5 million judgment against the company and other defendants. After a failed attempt at a joint venture, the plaintiff, United Business Services L.P. (UBS) sued Bankcard Processing International (BPI) and several other entities for fraud, breach of fiduciary duty, and breach of contract. Prior to trial, Jackson Walker successfully obtained a summary judgment holding that the parties' confidentiality and nondisclosure agreements were unenforceable. However, after a 28-day trial, the jury found against BPI and the other defendants and awarded the plaintiff $1.5 million in damages out of $15 million sought. On appeal, the Jackson Walker trial team argued that the damages award was not supported by legally sufficient evidence. The court agreed, reversed the trial court's judgment, and ruled that UBS take nothing on its causes of action. The appeals court also affirmed the trial court's ruling on the motions for summary judgment.  See Bankcard Processing International, LLC v.
